Terms of Service

Welcome to GrowHabit! These Terms of Service ("Terms") govern your use of the GrowHabit mobile application ("App") and related services (collectively, the "Services"). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using GrowHabit, you affirm that you are:

• At least 13 years old (or the age of majority in your jurisdiction)
• Capable of forming a binding contract
• Not prohibited from using the Services under applicable law

If you are using the App on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Account Registration

2.1 Authentication

GrowHabit supports two authentication methods:

• Anonymous Authentication: You can use GrowHabit without signing in. We create an anonymous Firebase account to enable app functionality. Anonymous users can use all free features and generate habits.
• Sign in with Apple: Required for Premium subscriptions. When an anonymous user upgrades to Premium, they are prompted to link their anonymous account with Apple ID. This preserves all existing data (habits, entries, settings) and enables Premium features.

You are responsible for:

• Maintaining the confidentiality of your Apple ID credentials (if you choose to sign in)
• All activities that occur under your account
• Notifying us immediately of any unauthorized access

2.2 Account Accuracy

You agree to provide accurate, current, and complete information. You may update your profile information at any time through the App settings.

2.3 Account Termination

You may delete your account at any time from Settings → Data & Privacy → Delete Account. We reserve the right to suspend or terminate accounts that violate these Terms.

3. Subscription and Payments

3.1 Free Tier

GrowHabit offers a free tier with limited features:

• Basic habit tracking and statistics
• 2 AI-powered habit roadmaps per week (enforced server-side)
• Banner advertisements and optional rewarded video ads displayed within the app. After completing onboarding, we request tracking permission via Apple's App Tracking Transparency (ATT) framework to serve personalized ads. You can decline this permission and still use all free features with non-personalized ads.
• Anonymous authentication (no sign-in required)

3.2 Premium Subscription

Premium subscriptions unlock additional features:

• 200 AI-powered habit roadmaps per month (soft limit, enforced server-side)
• Ad-free experience
• Advanced statistics and heat maps
• Script library for saving motivational content (feature available but not actively promoted)
• HealthKit integration (optional, user-controlled)
• Cloud sync across devices
• Home screen widgets (3 sizes)
• Live Activity support (Dynamic Island + Lock Screen)

Account Linking: Anonymous users who purchase Premium will be prompted to link their account with Apple ID to preserve data and enable Premium features. This is a one-time process that merges your anonymous account with your Apple ID.

3.3 Payment Terms

• Subscriptions are processed through Apple's App Store and governed by Apple's Terms of Service
• Payments are charged to your Apple ID account upon confirmation of purchase
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage subscriptions and disable auto-renewal in iOS Settings → [Your Name] → Subscriptions

3.4 Refunds

All purchases are subject to Apple's refund policy. To request a refund, contact Apple Support directly. We do not have access to or control over Apple's billing system.

3.5 Free Trials

If we offer a free trial, you must cancel before the trial period ends to avoid being charged. Trial eligibility is determined by Apple and may be limited to one per Apple ID.

3.6 Price Changes

We reserve the right to change subscription prices at any time. Price changes will not affect existing subscriptions until renewal. You will be notified of price changes in advance.

4. Acceptable Use

4.1 Permitted Uses

You may use GrowHabit for personal, non-commercial purposes to track your habits and personal growth.

4.2 Prohibited Activities

You agree NOT to:

• Violate any local, state, national, or international law
• Reverse engineer, decompile, or disassemble the App
• Use automated scripts or bots to interact with the Services
• Attempt to gain unauthorized access to our systems or other users' accounts
• Transmit viruses, malware, or other malicious code
• Abuse, harass, threaten, or intimidate other users or our staff
• Circumvent rate limits or usage restrictions (e.g., AI suggestion quotas)
• Scrape, crawl, or extract data from the Services
• Resell or redistribute the App or Services
• Use the App to generate content that violates our content policies

5. AI Features and Usage Limits

5.1 AI-Generated Content

• GrowHabit uses Google Gemini 2.5 Flash Lite AI to generate personalized habit roadmaps, suggestions, and motivational scripts
• AI features include: onboarding habit generation (based on focus selection and commitment period), custom habit roadmaps (based on category, goal days, and optional custom input up to 250 characters), and motivational scripts
• All user inputs are sanitized and validated server-side to prevent prompt injection attacks and ensure content relevance
• If custom input is deemed irrelevant (profanity, off-topic content, security threats), the system will ignore it and generate habits based on selected category and duration only
• AI-generated content is provided "as is" without warranties of accuracy or appropriateness
• You are responsible for reviewing AI suggestions before acting on them
• We do not guarantee that AI suggestions will help you achieve your goals
• AI-generated content is not used to train AI models

5.2 Rate Limits

• Free Users: 2 AI-powered habit roadmaps per week (enforced server-side, resets every Monday 00:00 UTC)
• Premium Users: 200 AI-powered habit roadmaps per month (soft limit, enforced server-side, resets on the 1st of each month 00:00 UTC)
• Rate limits apply to all AI features: onboarding habit generation, custom habit roadmaps, and motivational scripts
• Limits are tracked in Firestore and enforced by Firebase Cloud Functions (server-side validation)
• Quota resets are automatic and based on UTC timezone
• We reserve the right to adjust limits to prevent abuse or manage costs
• Anonymous users have the same quota limits as free users until they upgrade to Premium

5.3 Fair Use

Premium's 200/month limit is a soft limit designed for typical usage. We reserve the right to throttle or suspend accounts engaging in excessive or abusive AI usage, including but not limited to: automated script usage, prompt injection attempts, or generating content that violates our content policies.

5.4 Input Validation and Security

• Custom goal descriptions are limited to 250 characters and are sanitized server-side
• We implement prompt injection protection to prevent malicious manipulation of AI prompts
• Irrelevant or inappropriate inputs (profanity, security threats, off-topic content) are automatically filtered
• Users who repeatedly attempt to abuse AI features may have their accounts suspended

6. Intellectual Property Rights

6.1 Our Property

GrowHabit and all associated trademarks, logos, designs, code, and content are owned by us or our licensors. You may not use our intellectual property without written permission.

6.2 Your Content

You retain ownership of your habit data and user-generated content. By using the App, you grant us a limited license to:

• Store and process your data to provide the Services
• Use aggregated, anonymized data for analytics and improvement

We will never sell or share your personal content without your consent (see Privacy Policy).

6.3 AI-Generated Content

You may use AI-generated suggestions and scripts for personal use. We do not claim ownership of AI-generated content, but you acknowledge that similar content may be generated for other users.

7. Third-Party Services

GrowHabit integrates with third-party services:

• Apple Health (HealthKit): Optional integration governed by Apple's terms
• Apple Music (MusicKit): Optional integration governed by Apple's terms
• RevenueCat: Payment processing governed by RevenueCat's terms
• Firebase: Backend infrastructure governed by Google's terms
• AdMob: Advertising network governed by Google's terms

We are not responsible for third-party services' availability, accuracy, or policies. Your use of these services is subject to their respective terms.

8. Disclaimers and Limitations of Liability

8.1 No Medical Advice

8.2 Service Availability

We strive for 99.9% uptime but do not guarantee uninterrupted service. We may experience downtime for maintenance, updates, or unforeseen issues. We are not liable for any damages resulting from service interruptions.

8.3 "AS IS" Disclaimer

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability, fitness for a particular purpose, or non-infringement
• Accuracy, reliability, or completeness of content or AI suggestions
• Error-free or virus-free operation

8.4 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or goodwill
• Service interruptions or data loss
• Actions taken based on AI suggestions

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim, or $100 USD, whichever is greater.

8.5 Indemnification

You agree to indemnify and hold harmless GrowHabit and its affiliates from any claims, damages, or expenses arising from:

• Your violation of these Terms
• Your use of the Services
• Your violation of any third-party rights

9. Data and Privacy

9.1 Privacy Policy

Your use of GrowHabit is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

9.2 Data Export and Deletion

• Export: You can export your data as JSON from Settings → Data & Privacy → Export Data
• Delete: You can permanently delete your account from Settings → Data & Privacy → Delete Account
• Deletion is irreversible and may take up to 30 days to complete across all systems

9.3 Data Security

While we implement industry-standard security measures, no system is 100% secure. You acknowledge that you use the Services at your own risk.

10. Modifications to Services and Terms

10.1 Service Changes

We reserve the right to:

• Modify, suspend, or discontinue any feature at any time
• Change AI rate limits or pricing
• Add or remove third-party integrations

We will provide reasonable notice for material changes affecting paid features.

10.2 Terms Updates

We may update these Terms from time to time. Material changes will be communicated via:

• In-app notification
• Email (if provided)
• Updated "Last Updated" date at the top of this page

Your continued use after changes take effect constitutes acceptance. If you disagree, you must stop using the Services and may delete your account.

11. Termination

11.1 By You

You may stop using the App and delete your account at any time. Deleting the app does not cancel subscriptions; you must cancel through iOS Settings.

11.2 By Us

We may suspend or terminate your account if you:

• Violate these Terms
• Engage in fraudulent or abusive behavior
• Fail to pay subscription fees
• Request account deletion

We will provide notice when reasonably possible, but we may terminate immediately for serious violations.

11.3 Effect of Termination

Upon termination:

• Your right to use the Services immediately ceases
• Your data will be deleted within 30 days (unless legally required to retain)
• Subscriptions remain subject to Apple's policies
• Provisions that should survive (liability, indemnification) remain in effect

12. Dispute Resolution

12.1 Governing Law

These Terms are governed by the laws of [Your Jurisdiction], without regard to conflict of law principles.

12.2 Informal Resolution

Before filing a claim, you agree to contact us at [email protected] to attempt informal resolution. We will work in good faith to resolve disputes within 60 days.

12.3 Arbitration

If informal resolution fails, disputes will be resolved through binding arbitration rather than court litigation, except where prohibited by law. You and GrowHabit waive the right to jury trial or class action.

12.4 Exceptions

Either party may seek injunctive relief in court for intellectual property infringement or violations of these Terms.

13. General Provisions

13.1 Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and GrowHabit.

13.2 Severability

If any provision is found unenforceable, the remaining provisions remain in full effect.

13.3 Waiver

Our failure to enforce any provision does not constitute a waiver of that provision or any other provision.

13.4 Assignment

You may not transfer your rights under these Terms. We may assign our rights to any affiliate or successor without notice.

13.5 No Agency

These Terms do not create a partnership, joint venture, or employment relationship.

13.6 Force Majeure

We are not liable for delays or failures due to circumstances beyond our reasonable control (natural disasters, war, pandemics, etc.).
